Furu' Fiqh Research Method Among Usul Scholars in The Book of Husul al-Ma'mul

Abstract

This study focuses on one of the most important aspects of research methodology in the discipline of usul al-fiqh, namely the method of studying scholarly disagreement in foundational legal issues. This includes defining the point of dispute, clarifying its causes, and identifying its practical implications in legal questions. To illustrate this topic, the study examines the book Husul al-Ma’mul min ‘Ilm al-Usul by Muhammad Hasan Siddiq Khan al-Qannawji. The study adopts a descriptive and analytical approach to explain the elements of the topic, through the presentation and examination of selected examples from the book. It concludes by uncovering the author’s methodology in addressing juristic disagreements, which involves different approaches to defining the point of dispute, followed by an explanation of the causes and consequences of such disagreements. The study also identifies methodological principles employed by the author when analysing issues in Husul al-Ma’mul min ‘Ilm al-Usul. Furthermore, the discussion of the methodological plan followed by the author in dealing with scholarly disagreements reinforces the idea that usul scholars adhered to a systematic scientific approach in foundational legal research. The study also highlights the significance of the book Husul al-Ma’mul.
