Attachment of Earnings Order: A Literature Review

Abstract

A research has been made by distributing surveys forms to the respondents consist of Shariah Lawyers from private lawfirm, Biro Bantuan Guaman, academics in institutions of higher learning and Islamic officials whom were ex-Shariah Lawyer around Selangor State. From the surveys, some problems on the enforcement of courts orders on maintenance were identified. In the enforcement order in some problems occurred which payroll deductions of ex-husbands cannot be done because of exchange workplace and employers. Besides, one of the problems is that Muslim employers or else are not cooperating in the process of deducting salary. From the surveys form, it was found that the problems occurred caused by employers as they were not being cooperative. Therefore, this survey will see how an enforcement in attachment of earnings order can be implement in alimony payments.
